A HERDSMAN from Inyathi who allegedly sodomised his employer’s children, a boy aged five and an eight-year-old girl over a period of one year, has been arrested.

The man (24) (name withheld to protect the minors) of Siganda area in Inyathi allegedly had anal sex with the children multiple times between January and December 2016. He allegedly damaged the children’s sphincter muscles and they can no longer hold in stools when nature calls.

A court in Bulawayo yesterday heard that the juvenile’s parents were in South Africa, seeking employment, while the children were left in the custody of the herdsman and a maid who was his lover.

The man appeared before Regional Magistrate Mr Crispen Mberewere facing two counts of aggravated indecent assault. He pleaded not guilty and was remanded in custody to today.

“I didn’t rape the children. I have been working for this family for some years and their parents did not pay me. They are now lying saying that I raped their children so that l can go to jail,” said the man. Prosecuting, Mr Busani Moyo said the maid quit her job and left the children with the accused.

  • A Kadoma man has been arrested for attempting to sell his eight-year-old daughter to a Chivhu businessman for ritual killing.

    Tapiwa Vhutani (27) of Kumboedza Farm in Kadoma was arrested after he continuously pestered businessman Obert Juru – son to Bishop Ollah Juru – that he was selling his daughter for $12 000.

    Vhutani appeared before Magistrate Winfilda Tiyatara at Chivhu Magistrate Court last week facing allegations of “conspiracy to commit murder”, contravening Section 188 (1) (b) as read with section 47 (1) of the Criminal Law (Codification and Reform) Act, chapter 9:23.

    He was remanded in custody to this Tuesday.

    According to state papers, Vhutani was trapped and arrested on the spot by the Chivhu Criminal Investigations Department (CID) police while attempting to hand over his daughter to another team of law enforcement agents who posed as potential buyers.

    In his statement to the police which was presented in court, Vhutani said he had heard through the media that there are people from South Africa who buy children for killing to enhance business fortunes.

  • An HIV-positive man who sodomised a 17-year-old boy after luring him into his tuckshop was sentenced to 15 years in jail by a Chitungwiza magistrate last week. Prosecutor Mr Loveti Muringwa told the court that cases of sodomy were on the increase in Chitungwiza. 

    Maxwell Chisvo (28) pleaded not guilty to aggravated indecent assault before magistrate Ms Estere Chivasa on Wednesday, but was convicted due to overwhelming evidence.

    The court heard that on May 10 this year at around 5pm, the teenager went to Chisvo’s tuckshop to charge his cellphone. As Chisvo was alone he pleaded with the teenager to attend to his customers from 7pm to 9pm, promising to pay him a dollar.

    He said he had a headache. The teenager went back to his mother and was authorised to do the job. Chisvo asked the teenager to sleep over in the tuckshop and they shared a blanket. Around 11pm, Chisvo sodomised the boy who told his mother the following day.

  • A BULAWAYO man has been sentenced to 24 months in jail for torching his wife’s car. Jonathan Mbambo (34) pleaded guilty to malicious damage to property. The court heard that Mbambo smashed all the windows of Shirley Mashonganyika’s car. Ms Mashonganyika went into the car attempting to drive it out of the yard but Mbambo punctured all the tyres and threatened to burn her inside the vehicle. This prompted Ms Mashonganyika to rush to a police station to make a report and while she was at the station, Mbambo torched the car. Western commonage magistrate Mr Stephen Ndhlovu sentenced Mbambo to 24 months in prison which was wholly suspended. He was also fined $500. Mr Ndhlovu suspended 18 months of the sentence on condition that Mbambo restitutes Ms Mashonganyika $2 685 before September 30 and the remaining six months were suspended on condition he does not commit a smilar offence within the next five years.

  • THERE was drama at Gweru Magistrate’s Court yesterday when a 32-year-old security guard wailed after he was sentenced to four years in prison for having sexual intercourse with a 13 year old Grade Seven pupil.

    Wilson Muzanenhamo of Mkoba 14 Suburb in Gweru appeared before Midlands Provincial Magistrate Mrs Phathekile Msipa facing one count of having sexual intercourse with a minor.

    He pleaded guilty. The magistrate sentenced him to four years in prison but he will serve an effective three years after Mrs Msipa suspended a year on condition of good behaviour.

    “I know I committed a terrible crime which is punishable but I plead with the court to be merciful with me. I have a family and I’m the breadwinner,” said the security guard. The magistrate told him “to cool down.” Mrs Msipa said the accused violated an innocent girl.

    “The accused person had unprotected sexual intercourse with the girl knowing that she was a minor — a Grade Seven pupil — risking her contracting HIV and other sexual related diseases. It’s quite clear that the accused person was only using the complainant for sexual intercourse since he has a wife and children at home,” she said.

    Prosecuting, Mr Andrew Marimo said sometime in May, Muzanenhamo proposed love to the complainant and she agreed. “On May 25, the accused person then had unprotected sexual intercourse with the complainant once with her consent,” said Mr Marimo.

    He said on June 2, Muzanenhamo also had unprotected sexual intercourse at the premises he was guarding.

  • A 22-YEAR-OLD Bulilima woman has been arrested for allegedly forcing her husband’s 14-year-old nephew to have sexual intercourse with her.

    The woman who cannot be named to protect the identity of the juvenile appeared before Plumtree magistrate, Mr Joshua Mawere, facing aggravated indecent assault charges.

    She was not asked to plead and was remanded in custody to June 15. Prosecuting, Mrs Rose Sibanda said the Madlambuzi woman met the juvenile, a Form Two pupil, sometime in January while he was looking for donkeys.

    She undressed and ordered him to have sexual intercourse with her. Mrs Sibanda said the woman threatened her nephew and told him not to report the matter to anyone.

    She said sometime in April rumours started spreading in the community that the juvenile had slept with his aunt. Mrs Sibanda said the juvenile revealed what had transpired to his mother after she confronted him. The matter was reported to the police resulting in the woman’s arrest.

  • KWEKWE City Council has taken the Zimbabwe National Water Authority (Zinwa) to court for cutting off water supplies to the town over a $1,5 million debt without a court order.

    Kwekwe City Council, through its lawyers Mutatu and Partners, filed an urgent chamber application at the Bulawayo High Court citing Zinwa as the respondent.

    The council seeks an order directing Zinwa to restore full water supply to the town forthwith pending the finalisation of a court application for declaratur filed under case number HC1349/17 at the Bulawayo High Court.

    The local authority also wants Zinwa to be interdicted from interfering with water supplies until the matter before the court is finalised.

    The Midlands city has been without running water since last week forcing residents to resort to unprotected water sources.

  • A MALE teacher at one of Bulawayo affluent private schools, Christian Brothers College (CBC), was allegedly caught by other pupils while allegedly caressing a Form Three boy in a classroom.

    Sindiso Mafikela (46) of Langdon House situated in Bulawayo’s Central Business District recently appeared before Bulawayo magistrate Mr Manasa Musiiwa facing a charge of indecent assault.

    Mafikela appeared in court three times before he was subsequently placed off remand. The State will however, proceed by way of summons.

  • A 20-year-old sports coach at a Bulawayo school has been arrested for allegedly plying a 14-year-old pupil with alcohol and raping her overnight.

    A court heard that the teen is in the man’s sports team at school.Allegations are that the coach, whose identity is being withheld, intoxicated the teen, spent the night with her and sent her home the following morning.

    Western Commonage Magistrate Mr Lungile Ncube did not ask him to plead to a rape charge. He remanded him in custody to June 16.

    Prosecuting, Mr Mufaro Mageza told the court that the coach got the pupil drunk in September last year and took her to his home where he raped her once overnight.

    “Accused person met complainant while she was walking home. He asked her to accompany him to his home. Accused gave complainant some alcohol and she got drunk. He raped her once. Complainant returned to her place of residence the following morning,” said Mr Mageza.

  • A BULAWAYO woman has been ordered to perform community service for sending obscene messages and pictures to the wife of a man who was having a love affair with her younger sister.

    Admitter Mpofu (26) of Nkulumane suburb told Simangele Lusinga (36) of Cowdray Park suburb on Friday last week that her husband was not coming home, hence she was going to sleep alone.

    Mpofu, who is married and a mother of three, was convicted on her own plea of guilty to contravening the Post and Telecommunications Act that prohibits sending of gross, offensive, indecent, obscene or threatening material over the phone.

    Western Commonage Magistrate Mr Lungile Ncube ordered her to perform 105 hours of community service.

    Mpofu apologised to the court for her misconduct.

  • A 26- YEAR-OLD serial thief who escaped from Bulawayo Central Police Station in 2013 after his arrest for stealing 546 cellphones worth about $35 000, yesterday appeared in court.

    Blessing Gwashavanhu of Kambuzuma in Harare allegedly stole the phones and nearly $7 100 cash from shops in Bulawayo’s Central Business District.

    Gwashavanhu was detained in July 2013 but he escaped from the police station during the night by using an electrical cable to swing onto the roof of the holding cell.

    He was arrested again in April this year, when he stole from Harare shops and detectives transferred him to Bulawayo to deal with his pending cases. Gwashavanhu has already been convicted of a number of theft cases in Harare.

    He appeared before Mr Tinashe Tashaya facing charges of escaping from lawful custody, unlawful entry and theft. He pleaded guilty to escaping from lawful custody but denied the theft charges.

    Mr Tashaya remanded him in custody to June 8 for commencement of trial.

  • A 68-YEAR-OLD Chiredzi man will spend the next 14 years in jail for sodomising his neighbour’s five-year-old son. Makasani Gosha Mukondo sexually abused the boy after his mother sent him to collect dried vegetables at Mukondo’s homestead.

    Chiredzi senior regional magistrate Mrs Judith Zuyu convicted Mukondo on his own plea of guilty on Monday. Mrs Zuyu sentenced him to 17 years in jail before suspending three years on condition of good behaviour.

    Delivering sentence Mrs Zuyu said Mukondo acted wickedly when he sexually assaulted an innocent boy who looked up to him for protection. “What you did to the innocent boy does not only defy logic but shows that you harbour some animalistic spirit.

    The court heard the woman ordered her son to accompany Mukondo to his house to get the vegetables.

    “Upon entering the house Mukondo ordered the boy to lower his trousers and he had anal sex with him against the victim’s consent. After committing the crime, Mukondo gave the victim the dried vegetables but told the boy not to tell anyone what had happened. When he arrived home, his mother asked why he had taken long and he narrated what had transpired,” said Ms Rusere.

    She said a report was made to Hippo Valley Police leading to Mukondo’s arrest. A medical report produced in court indicated that there was penetration on the boy.
